Some time I go see the following information: the Ketum, a cream used by athletes, was reauthorized in emergency by the State Council, and it would be crass economic reasons for disregarding the public health. Several newspapers have echoed it.
Afssaps has indeed suspended by decision of 17 December 2009 the sale of products containing ketoprofen due to a health risk. The State Council overturned an interim decision January 26, 2010.
Why have we heard? Because the media have interpreted the decision through the administrative court Supreme and it was written that the Council of State would give priority to economic considerations over those of public health.
What is true is that the State Council has partly justified its decision by citing the financial impact of the decision AFSSAPS for the producer concerned, the ketum constituting its second most important product, so that the decision undermined the marketing of its viability.
But what any lawyer would point out is that taking into account the economic impact by the State Council was unlikely to decide the bottom end but to decide whether the procedure of referred was open.
The summary procedure, which can act very quickly, can be implemented only in certain cases, the assumption being that Queen of the emergency. And the economic case had to end so that the most likely to pave the way for interim relief.
